Welcome to ART.CO (“ART.CO,” “Company,” “we,” “us,” or “our”).

These Terms & Conditions (“Terms”) govern your access to and use of the ART.CO website, ticketing platform, events, experiences, products, services, communications, and related offerings (collectively, the “Services”).

By visiting our website, purchasing a ticket, registering for an event, participating in an ART.CO experience, submitting information to ART.CO, or otherwise participating in an ART.CO activity, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you should not purchase a ticket, register for, or participate in an ART.CO event.

ART.CO reserves the right to update these Terms from time to time. Updated Terms will become effective when posted unless otherwise required by applicable law. Your continued use of our website or participation in an event after an update constitutes acceptance of the revised Terms.


ABOUT ART.CO

ART.CO is a creative experience company designed to bring people together through art, creativity, premium wine tasting, charcuterie, and community.

Our experiences may include creative activities, art materials, paint, food, beverages, wine tasting, music, social interaction, photography, video, venue activities, and other entertainment or experiential elements.

ART.CO may operate events in different cities, states, countries, venues, outdoor spaces, private properties, restaurants, galleries, event spaces, hotels, cultural spaces, and other locations.

Because ART.CO travels, specific event details, rules, requirements, services, amenities, and restrictions may vary by location.

The event-specific information displayed on the applicable event page is incorporated into these Terms.


ART.CO EXPERIENCE

ART.CO experiences are designed to encourage creativity and self-expression.

Unless an event page expressly states otherwise, ART.CO is not a professional art school, art-therapy service, or traditional step-by-step painting class.

Guests may create artwork based on their own inspiration, interpretation, interests, and creative preferences.

ART.CO does not guarantee that any guest will produce a particular artistic result.

Artistic outcomes vary from person to person, and the purpose of the experience is participation, creativity, enjoyment, connection, and community.


EVENT TICKETS

Tickets provide admission to the specific ART.CO event identified on the ticket or confirmation.

Unless otherwise stated, the ticket price includes only the items expressly identified on the applicable event page.

Ticket prices, event capacity, included services, food selections, beverage offerings, venue, event schedule, and other event details may vary by location.

The advertised ticket price does not automatically include transportation, parking, lodging, additional food or beverages, merchandise, gratuities, or other expenses unless expressly stated.

Tickets are subject to availability.

ART.CO reserves the right to limit the number of tickets that may be purchased by an individual, household, organization, or group.

ART.CO may refuse or cancel transactions that appear fraudulent, unauthorized, duplicative, abusive, or inconsistent with event rules.


TICKET PURCHASES

When purchasing a ticket, you agree to provide accurate, current, and complete information.

You are responsible for reviewing your order before submitting payment.

You are responsible for maintaining access to the email address associated with your ticket.

ART.CO is not responsible for tickets, confirmations, reminders, or event communications that cannot be delivered because the purchaser provided an incorrect email address, telephone number, or other contact information.

A ticket confirmation is evidence of purchase but does not override event-specific requirements or these Terms.


TICKET PRICING AND PAYMENT

Unless otherwise stated, the standard ART.CO experience is priced at $175 per person.

Taxes, service fees, processing fees, venue fees, or other charges may apply where permitted or required.

All applicable charges will be displayed during the checkout process when reasonably practicable.

Payment must be successfully completed before a ticket is considered confirmed.

ART.CO reserves the right to correct pricing errors and, where legally permitted, cancel an order resulting from an obvious pricing or technical error.


TICKET CANCELLATIONS, REFUNDS, AND TRANSFERS

ART.CO's refund, cancellation, and transfer policy applicable to each event will be displayed during ticket purchase and/or on the event page.

Unless an event-specific policy states otherwise, ticket purchases should be considered final.

Where refunds are permitted, ART.CO may establish a deadline by which refund requests must be received.

Refunds, when approved, will generally be returned through the original payment method, subject to payment processor requirements.

Processing fees or other non-refundable charges may be excluded from a refund were permitted by law and disclosed at checkout.

ART.CO may offer ticket transfers, credits, or alternative accommodations at its discretion.

A ticket transfer does not automatically guarantee admission if the receiving attendee does not satisfy applicable age, identification, venue, or other event requirements.


EVENT CANCELLATION OR MODIFICATION BY ART.CO

ART.CO makes reasonable efforts to conduct events as advertised.

However, ART.CO reserves the right to modify, postpone, relocate, reschedule, or cancel an event when reasonably necessary, including because of:

  • Severe weather

  • Natural disasters

  • Public emergencies

  • Government restrictions

  • Venue closure

  • Venue-related problems

  • Safety concerns

  • Transportation disruptions

  • Utility failures

  • Staffing issues

  • Supplier problems

  • Food or beverage availability

  • Equipment failure

  • Insufficient ticket sales

  • Acts or threats of violence

  • Security concerns

  • Labor disruptions

  • Illness

  • Other circumstances beyond ART.CO's reasonable control

If ART.CO cancels or materially changes an event, ART.CO will communicate available options to ticket holders as required by applicable law and the applicable event policy.

Available remedies may include rescheduling, transferring a ticket to another event, issuing a credit, or providing a refund where applicable.

Unless required by law, ART.CO is not responsible for independent expenses incurred by guests, including airfare, hotels, transportation, parking, childcare, lost wages, or other costs associated with attending an event.


EVENT TIMES AND ARRIVAL

Event start and end times are provided as estimates unless otherwise expressly stated.

Guests are encouraged to arrive early enough to complete check-in before the scheduled start time.

Late arrival may result in reduced participation time or delayed entry when necessary to preserve the experience and safety of other guests.

ART.CO does not guarantee admission after a specified late-arrival cutoff.

Guests are responsible for arranging transportation to and from the event.


VENUE RULES

ART.CO may conduct events at third-party venues.

Guests must comply with:

  • ART.CO policies

  • Venue policies

  • Posted rules

  • Security instructions

  • Fire-safety requirements

  • Capacity limitations

  • Alcohol policies

  • Parking requirements

  • Dress requirements

  • Accessibility procedures

  • Instructions from authorized ART.CO personnel and venue personnel

A venue may have rules that are stricter than these Terms.

Where venue rules conflict with ART.CO policies, guests must comply with the applicable venue requirements.

ART.CO is not responsible for a guest's failure to comply with venue rules.


VENUE PARTNERS, MANAGERS, AND THIRD-PARTY PROVIDERS

ART.CO may work with venues, venue managers, property owners, caterers, wineries, beverage providers, artists, instructors, photographers, security personnel, ticketing companies, payment processors, transportation providers, contractors, temporary staff, and other third-party providers.

These parties may have separate terms, policies, licenses, insurance requirements, and operational responsibilities.

ART.CO does not represent that every third-party provider is owned or controlled by ART.CO.

Guests agree to follow reasonable instructions from authorized third-party venue and service personnel.

ART.CO may replace a venue, vendor, supplier, artist, caterer, beverage provider, or other contractor when reasonably necessary.

Such substitutions do not necessarily entitle a guest to a refund unless required by the applicable event policy or law.


FOOD AND CHARCUTERIE

ART.CO may provide individual premium charcuterie boards or other food items as part of an event.

Food offerings may vary by location and event.

ART.CO may offer vegan, vegetarian, gluten-free, and/or allergen-conscious options when stated on the event page.

Guests must communicate dietary restrictions and allergies through the designated registration or ticketing process.

ART.CO will make reasonable efforts to communicate dietary requirements to applicable food providers; however, ART.CO cannot guarantee that any food item will be completely free from an allergen or from incidental cross-contact.

Food may be prepared, packaged, transported, or served in environments where common allergens are present.

Potential allergens may include, without limitation:

  • Peanuts

  • Tree nuts

  • Milk

  • Eggs

  • Wheat

  • Gluten

  • Soy

  • Sesame

  • Fish

  • Shellfish

  • Other ingredients

Guests with severe or life-threatening allergies are responsible for determining whether participation is appropriate for them.

ART.CO does not represent that an “allergen-conscious,” “gluten-free,” “vegan,” or similar option is medically or clinically safe for every individual.

Guests should contact ART.CO before purchasing if they have questions regarding specific ingredients or food preparation.

Guests must not consume food they know or reasonably believe may be unsafe for them.


FOOD SAFETY

ART.CO and its food-service partners will follow applicable food-safety requirements appropriate to the location and service model.

ART.CO may use licensed caterers, restaurants, food vendors, event kitchens, or other food-service providers.

Food may be served at different temperatures and in different formats depending on the venue.

Guests should promptly notify ART.CO or venue staff if they believe food has been improperly handled, contaminated, mislabeled, or otherwise presents a safety concern.

ART.CO reserves the right to remove any food item from service when a food-safety concern arises.


WINE AND ALCOHOL

Certain ART.CO experiences may include premium wine tasting or other alcoholic beverages.

Alcohol availability and service are subject to the laws and regulations of the jurisdiction where the event occurs.

ART.CO may work with licensed venues, caterers, bartenders, servers, wineries, or other authorized alcohol-service providers.

Guests must comply with all applicable age and identification requirements.

Valid government-issued identification may be required.

ART.CO and its authorized partners reserve the right to refuse alcohol service to anyone when required or permitted by applicable law or responsible-service policies.

ART.CO may refuse service to a person who appears intoxicated, is behaving dangerously, is attempting to provide alcohol to an unauthorized person, or otherwise violates applicable alcohol policies.

Guests may not bring outside alcohol unless the venue and applicable law expressly permit it.

Guests are responsible for arranging safe transportation after consuming alcohol.

Do not drink and drive.

ART.CO strongly encourages guests who consume alcohol to use a designated driver, rideshare, taxi, public transportation, or another safe transportation option.

ART.CO does not encourage excessive alcohol consumption.


AGE REQUIREMENTS

Alcohol-related events may have age restrictions.

The minimum age for an event will be identified on the applicable event page when applicable.

Guests are responsible for bringing valid identification when required.

ART.CO reserves the right to deny entry when a guest cannot satisfy applicable age or identification requirements.

A guest denied entry because they cannot satisfy an advertised age or identification requirement may be subject to the applicable ticket refund policy.


PAINT, ART MATERIALS, AND CHEMICALS

ART.CO events may involve paint, pigments, inks, adhesives, sealants, cleaning products, solvents, art mediums, or other materials.

Specific materials vary by event.

Guests must use all materials only as instructed and only for their intended purpose.

Guests must not intentionally ingest, inhale, misuse, throw, spray, apply to another person's body, or otherwise misuse art materials.

Paint and other art materials may stain:

  • Clothing

  • Shoes

  • Bags

  • Furniture

  • Flooring

  • Walls

  • Vehicles

  • Personal belongings

ART.CO recommends wearing clothing and footwear appropriate for an art activity.

Guests are responsible for protecting their personal property.

ART.CO is not responsible for ordinary staining or damage to personal belongings resulting from participation in the experience, except to the extent such limitation is prohibited by applicable law.


MATERIAL SAFETY AND SENSITIVITIES

ART.CO will select event materials appropriate for the intended activity and will follow applicable manufacturer instructions and venue requirements.

Guests should notify ART.CO before participating if they have a known sensitivity to paints, pigments, fragrances, adhesives, cleaning products, latex, or other materials that may reasonably be present.

ART.CO may be unable to accommodate every sensitivity.

Guests should not use a material if they know they are allergic or sensitive to it.

Guests must follow all posted safety instructions and directions provided by ART.CO staff.


PERSONAL PROPERTY

Guests are responsible for their own belongings.

ART.CO does not guarantee the security of purses, phones, wallets, jewelry, clothing, artwork, coats, luggage, or other personal property.

Guests should avoid bringing unnecessary valuables.

ART.CO is not responsible for lost, stolen, misplaced, or damaged personal property except where liability cannot lawfully be excluded.

Lost-and-found items may be retained for a limited period.


PERSONAL CONDUCT

ART.CO is intended to be a welcoming and respectful environment.

Guests must conduct themselves in a manner that does not threaten, intimidate, harass, endanger, or interfere with other guests, employees, contractors, vendors, venue personnel, or community members.

Prohibited conduct includes, without limitation:

  • Fighting

  • Threatening behavior

  • Harassment

  • Discrimination

  • Sexual harassment

  • Unwanted physical contact

  • Abuse

  • Intimidation

  • Theft

  • Property damage

  • Deliberate misuse of art materials

  • Dangerous behavior

  • Excessive intoxication

  • Possession of prohibited items

  • Disruptive conduct

  • Refusal to follow reasonable safety instructions

  • Unauthorized commercial activity

  • Any unlawful conduct

ART.CO may remove a guest from an event without refund when the guest violates these Terms, creates a safety concern, or materially disrupts the event.

ART.CO may contact venue security or law enforcement when appropriate.


HARASSMENT AND DISCRIMINATION

ART.CO seeks to provide an environment where guests, staff, artists, vendors, partners, and community members can participate respectfully.

ART.CO does not tolerate unlawful discrimination, harassment, threats, or abusive behavior.

Reports concerning inappropriate conduct may be made to ART.CO staff or through the contact information provided on the website.

ART.CO may investigate complaints and take appropriate action.


CHILDREN AND MINORS

Some events may permit minors while others may be adults-only.

The applicable event page will identify age restrictions.

Parents and legal guardians are responsible for minors in their care unless ART.CO has expressly agreed in writing to provide supervision.

ART.CO does not provide childcare.

Minors must comply with all event rules and venue requirements.

Minors may not consume alcohol.


ACCESSIBILITY AND ACCOMMODATIONS

ART.CO seeks to make its experiences accessible to guests with disabilities and will work with venues and vendors to provide reasonable accommodations where required by applicable law and reasonably available.

Because events occur at different venues, accessibility features may vary.

Guests who require an accommodation should contact ART.CO before purchasing when possible so the Company can coordinate with the venue.

ART.CO cannot guarantee that every venue will have every desired accessibility feature.


WEATHER AND OUTDOOR EVENTS

Some ART.CO events may occur partially or entirely outdoors.

Outdoor events may be affected by:

  • Rain

  • Heat

  • Cold

  • Wind

  • Lightning

  • Severe weather

  • Poor air quality

  • Other environmental conditions

ART.CO may modify an outdoor event, move it indoors, delay it, reschedule it, or cancel it when necessary for safety.

Guests should review event-specific weather and venue information before attending.


PHYSICAL ACTIVITY AND GENERAL RISKS

ART.CO experiences may involve standing, walking, reaching, bending, carrying lightweight materials, handling art supplies, navigating event spaces, sitting for extended periods, and interacting with other guests.

Potential risks may include slips, trips, falls, spills, stains, minor cuts, burns, allergic reactions, food-related illness, alcohol-related incidents, and other foreseeable or unforeseeable risks associated with attending a live event.

Guests voluntarily assume ordinary risks associated with participation to the extent permitted by applicable law.


PERSONAL HEALTH RESPONSIBILITY

Guests are responsible for determining whether they are physically and otherwise able to participate.

ART.CO does not provide medical advice or medical supervision.

Guests should inform appropriate personnel of an emergency or medical concern immediately.

ART.CO staff may contact emergency services when reasonably necessary.

Guests are responsible for providing accurate emergency contact information when requested.


EMERGENCIES

ART.CO may take reasonable action during an emergency to protect guests, staff, vendors, and property.

This may include:

  • Evacuation

  • Temporary event suspension

  • Relocation

  • Contacting emergency services

  • Restricting access to certain areas

  • Closing portions of the event

  • Following venue emergency procedures

Guests must follow emergency instructions from ART.CO, venue personnel, security personnel, and emergency responders.


PHOTOGRAPHY, VIDEO, AND RECORDING

ART.CO events may be photographed, filmed, livestreamed, or otherwise recorded for marketing, documentation, social media, advertising, promotional materials, websites, publications, and other legitimate business purposes.

By entering an ART.CO event, you acknowledge that you may appear incidentally in photographs, video, or other recordings.

Where ART.CO requires a separate media release or consent for a particular use, that release will apply.

Guests who do not wish to be photographed or recorded should notify ART.CO staff upon arrival and follow any designated procedures.

ART.CO cannot guarantee that a guest will never appear incidentally in a wide-angle event recording or background image where legally permitted.

ART.CO will not knowingly use a guest's likeness in a misleading endorsement without appropriate consent.


ARTWORK CREATED AT EVENTS

Artwork created by guests remains the guest's property unless otherwise expressly agreed.

ART.CO does not guarantee that artwork will survive transportation, drying, storage, handling, weather exposure, or other circumstances.

Guests are responsible for safely transporting completed artwork unless ART.CO provides a separate transportation or packaging service.

ART.CO may photograph artwork for documentation and promotional purposes.

Guests retain rights they otherwise possess in their original artwork, subject to any separate agreement.


INTELLECTUAL PROPERTY

ART.CO's name, logo, trademarks, branding, designs, website content, graphics, photographs, videos, written materials, marketing materials, event concepts, and other proprietary content may be protected by intellectual-property laws.

Nothing in these Terms grants a guest ownership of ART.CO intellectual property.

Guests may not reproduce, sell, distribute, modify, copy, license, or commercially exploit ART.CO branding, artwork, promotional materials, or proprietary content without written permission.

Guests may take personal photographs and videos for personal, non-commercial use unless prohibited by the venue or event-specific rules.

Commercial photography, filming, influencer campaigns, brand activation, or promotional use may require prior written approval.


THIRD-PARTY INTELLECTUAL PROPERTY

ART.CO may display music, artwork, logos, brands, photographs, products, or other materials owned by third parties.

ART.CO does not claim ownership of third-party intellectual property.

Use of third-party materials will be subject to applicable rights, licenses, permissions, and restrictions.


WEBSITE USE

You agree to use the ART.CO website lawfully and responsibly.

You may not:

  • Attempt to gain unauthorized access

  • Interfere with website functionality

  • Introduce malicious code

  • Scrape or harvest information unlawfully

  • Impersonate another person

  • Submit fraudulent information

  • Use the website to harass others

  • Attempt to bypass security measures

  • Purchase tickets through unauthorized automated systems

  • Resell tickets in violation of applicable policies or law

  • Use ART.CO content for unauthorized commercial purposes

ART.CO may suspend or restrict access to users who violate these Terms.


ACCOUNTS AND CUSTOMER INFORMATION

If ART.CO provides account functionality, users are responsible for maintaining the confidentiality of their login credentials.

You are responsible for activity conducted through your account unless unauthorized activity resulted from ART.CO's failure to maintain appropriate security as required by law.

ART.CO may require additional verification for certain transactions.


PRIVACY

ART.CO may collect information necessary to operate the website, process ticket purchases, communicate with guests, administer events, provide customer service, and operate the business.

Information will be handled according to ART.CO's separate Privacy Policy.

The Privacy Policy should be reviewed before submitting personal information.


PAYMENT PROCESSORS AND THIRD-PARTY SERVICES

ART.CO may use third-party payment processors, ticketing platforms, email providers, scheduling services, website providers, analytics services, and other technology providers.

Third-party services may have separate terms and privacy policies.

ART.CO does not control every aspect of third-party systems.

A payment may be subject to the payment processor's verification, authorization, fraud-prevention procedures, and terms.


PARTNERSHIP AND VENUE AGREEMENTS

Venue owners, managers, landlords, sponsors, contractors, caterers, artists, and other professional partners may be required to enter separate written agreements with ART.CO.

These agreements may address:

  • Venue rental

  • Setup and breakdown

  • Cleaning

  • Security

  • Insurance

  • Certificates of insurance

  • Indemnification

  • Alcohol service

  • Food service

  • Staffing

  • Equipment

  • Utilities

  • Parking

  • Accessibility

  • Property damage

  • Cancellation

  • Force majeure

  • Payment

  • Confidentiality

  • Intellectual property

  • Marketing rights

  • Photography

  • Safety

  • Compliance with laws

These commercial agreements are separate from guest ticket Terms.


ART.CO CONTRACTORS AND STAFF

ART.CO may use employees, independent contractors, temporary workers, volunteers, artists, event managers, venue personnel, and other service providers.

Each person may have different responsibilities.

Guests should direct event questions to designated ART.CO personnel.

Guests should not instruct vendors, contractors, or staff to perform unauthorized services, move equipment, modify venue infrastructure, or provide restricted products.


PROPERTY DAMAGE

Guests are responsible for damage they intentionally or negligently cause to ART.CO property, venue property, vendor property, or another person's property, to the extent permitted by law.

This includes damage caused by misuse of:

  • Furniture

  • Art supplies

  • Paint

  • Equipment

  • Tables

  • Decorations

  • Glassware

  • Walls

  • Floors

  • Fixtures

  • Technology

  • Other event property

ART.CO may seek reimbursement for documented damage when legally permitted.


CLEANLINESS AND SANITATION

Guests must use designated waste, food, beverage, and art-material disposal areas.

Guests must not intentionally spill, throw, smear, or distribute paint, food, beverages, chemicals, or other materials outside designated areas.

ART.CO may charge a guest for extraordinary cleaning or damage caused by intentional or negligent conduct where legally permitted and appropriately disclosed.


PROHIBITED ITEMS

Events may prohibit items that create safety, legal, venue, or operational concerns.

Unless expressly authorized, guests should not bring:

  • Outside alcohol

  • Illegal drugs

  • Weapons

  • Hazardous substances

  • Flammable materials

  • Unauthorized chemicals

  • Large commercial equipment

  • Items that create unreasonable safety risks

  • Items prohibited by the venue

Venue-specific prohibited-item lists may apply.


TICKET RESALE

ART.CO may restrict unauthorized resale of tickets.

Tickets obtained through unauthorized resale channels may be canceled where permitted by law and applicable event policies.

ART.CO is not responsible for tickets purchased through unauthorized third parties.

Guests should purchase tickets directly through ART.CO's official website or an authorized ticketing provider.


FRAUD AND CHARGEBACKS

ART.CO reserves the right to investigate suspicious transactions.

A guest who initiates a payment dispute or chargeback without first attempting to resolve a legitimate billing issue may have future ticket purchases restricted, subject to applicable law.

Nothing in this section limits a consumer's rights under applicable law.


PROMOTIONS AND DISCOUNTS

Promotional offers, discounts, giveaways, referral programs, and special pricing may be subject to separate terms.

Unless otherwise stated, promotions cannot be combined.

ART.CO may modify or discontinue a promotion where legally permitted.


GIFT TICKETS

Gift tickets may be subject to the same event policies, expiration rules, transfer restrictions, and refund policies applicable to standard tickets.

The purchaser is responsible for providing accurate recipient information.


CUSTOMER COMMUNICATIONS

By purchasing a ticket or providing contact information, you may receive transactional communications related to your purchase or event.

These may include:

  • Purchase confirmations

  • Ticket information

  • Event reminders

  • Venue updates

  • Schedule changes

  • Safety information

  • Cancellation notices

  • Customer-service communications

Marketing communications will be handled in accordance with applicable law and ART.CO's Privacy Policy.


SOCIAL MEDIA

ART.CO may maintain social-media accounts on third-party platforms.

Interactions with ART.CO on social media may be subject to both these Terms and the third-party platform's terms.

ART.CO does not control third-party platform availability, policies, algorithms, or content moderation.


USER-SUBMITTED CONTENT

If you submit photographs, videos, comments, artwork, reviews, testimonials, suggestions, or other content to ART.CO, you represent that you have the right to submit the content.

Unless otherwise agreed in writing, you grant ART.CO a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and promote submitted content for ART.CO's business, marketing, advertising, social media, website, and promotional purposes, subject to applicable law.

You retain ownership of your underlying intellectual property unless otherwise agreed.

ART.CO may remove user-submitted content that is unlawful, abusive, defamatory, infringing, inappropriate, or inconsistent with ART.CO's community standards.


REVIEWS AND TESTIMONIALS

Guests may be invited to provide reviews or testimonials.

Reviews should be honest and based on the guest's actual experience.

ART.CO may use testimonials in accordance with applicable law and any required consent.

ART.CO does not require guests to provide positive reviews.


ACCESS TO THE EVENT

ART.CO reserves the right to deny or revoke admission when reasonably necessary for safety, security, compliance with venue rules, legal requirements, or protection of guests and personnel.

Where admission is denied because of a guest's violation of these Terms, applicable event rules, or venue rules, the guest may not be entitled to a refund.


NO GUARANTEE OF SPECIFIC EXPERIENCE

ART.CO makes reasonable efforts to deliver the experience described on the event page.

However, specific:

  • Wines

  • Food items

  • Art materials

  • Artists

  • Vendors

  • Venues

  • Decor

  • Music

  • Seating arrangements

  • Schedules

  • Activities

may change due to availability, safety, licensing, venue requirements, or circumstances outside ART.CO's reasonable control.

ART.CO may provide a reasonably comparable substitute where appropriate.

ASSUMPTION OF RISK

  • Spills

  • Contact with paint or art materials

  • Minor injuries

  • Food allergies

  • Food-related illness

  • Alcohol-related risks

  • Property damage

  • Weather exposure

  • Interaction with other guests

  • Venue-related hazards

  • Transportation-related risks

  • Unexpected event conditions

You voluntarily assume ordinary risks associated with participation.


RELEASE AND LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ART.CO, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, EVENT STAFF, AFFILIATES, REPRESENTATIVES, PARTNERS, SPONSORS, AND AUTHORIZED SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN AN EVENT OR USE OF THE WEBSITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ART.CO'S TOTAL LIABILITY ARISING FROM AN EVENT OR TICKET PURCHASE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID ART.CO FOR THE SPECIFIC EVENT GIVING RISE TO THE CLAIM.

THIS SECTION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

NOTHING IN THESE TERMS IS INTENDED TO WAIVE RIGHTS OR REMEDIES THAT CANNOT LEGALLY BE WAIVED.


INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ART.CO and its owners, officers, directors, employees, contractors, agents, affiliates, partners, sponsors, and service providers from claims, damages, liabilities, losses, costs, and reasonable expenses arising from:

  • Your violation of these Terms

  • Your violation of applicable law

  • Your misuse of ART.CO property

  • Your misuse of art materials

  • Your misconduct

  • Your intentional or negligent damage to property

  • Your infringement of another person's intellectual-property rights

  • Your unauthorized commercial use of ART.CO content

  • Your conduct toward another guest, vendor, employee, contractor, or venue representative

This provision does not require indemnification to the extent prohibited by applicable law.


NO PROFESSIONAL MEDICAL, LEGAL, OR OTHER ADVICE

ART.CO is an entertainment and creative-experience company.

ART.CO does not provide medical, legal, financial, nutritional, therapeutic, or professional health advice through its events or website.

FORCE MAJEURE

TRAVEL AND INTERNATIONAL EVENT EXPENSES

Unless expressly included in a ticket or separate agreement, ART.CO ticket prices do not include:

  • Flights

  • Hotels

  • Transportation

  • Travel insurance

  • Passport costs

  • Visa costs

  • Meals outside the event

  • Parking

  • Baggage fees

  • Currency exchange costs

  • Personal expenses

Guests attending an international ART.CO event are responsible for determining whether they are legally permitted to enter the destination country.


COMPLIANCE WITH LOCAL LAW

ART.CO intends to operate in accordance with applicable laws and regulations in each jurisdiction where it conducts business.

Because ART.CO travels across multiple states and countries, requirements may vary concerning:

Venues, contractors, vendors, and other partners may maintain separate insurance requirements.

The existence of insurance does not create a contractual promise to any individual guest regarding coverage or payment.


GOVERNING LAW

These Terms will be governed by the laws specified in the governing-law provision adopted by ART.CO, subject to applicable consumer-protection and other mandatory laws.

Because ART.CO operates across multiple jurisdictions, the Company should designate its governing law and dispute forum in consultation with legal counsel.

Nothing in these Terms is intended to deprive a consumer of mandatory rights granted by the laws applicable to that consumer.


DISPUTE RESOLUTION

Before filing a formal legal claim, guests are encouraged to contact ART.CO and provide an opportunity to resolve the matter informally.

Where permitted by applicable law, ART.CO may require certain disputes to be resolved through mediation or arbitration pursuant to a separate dispute-resolution provision.

NO WAIVER

ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, applicable event policies, ticket purchase terms, venue-specific rules, and any other written agreement expressly incorporated by reference, constitute the agreement between you and ART.CO regarding your use of the applicable Services.

Separate written agreements with venues, vendors, contractors, sponsors, artists, or other business partners may contain additional or different terms applicable to those relationships.


ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without ART.CO's written consent, except where applicable law provides otherwise.

ART.CO may assign its rights or obligations in connection with a merger, acquisition, restructuring, sale of assets, or other business transaction.


ELECTRONIC COMMUNICATIONS

YOU AGREE TO FOLLOW ALL SAFETY INSTRUCTIONS, VENUE RULES, ART MATERIAL INSTRUCTIONS, FOOD-SERVICE REQUIREMENTS, ALCOHOL POLICIES, AND DIRECTIONS PROVIDED BY AUTHORIZED ART.CO OR VENUE PERSONNEL.

YOU ALSO ACKNOWLEDGE THAT EVENT DETAILS MAY VARY BY LOCATION AND THAT YOU ARE RESPONSIBLE FOR REVIEWING THE SPECIFIC EVENT INFORMATION ASSOCIATED WITH YOUR TICKET.
